CONDITIONS OF USE

Welcome to the website https://headshere.pro/ (“Platform”), where Heads Here LLC (“HEADS HERE”) provides services (“HEADS HERE Services”). Please carefully read these terms of use, which pertain to your and HEADS HERE’s rights and obligations. By using the Platform, you agree to the terms of use (“Service Terms”), which constitutes a form of a sales agreement for the Service (“Sales Agreement”). In case of purchasing HEADS HERE services (“Service Purchase”), we will ask you to confirm that you accept the Service Terms.

TERMS OF USE OF THE PLATFORM

You can use the Platform 24 hours a day, 7 days a week, except for technical breaks. To use the Platform, you must meet the minimum technical requirements:

• Access to an internet browser: (latest official release recommended), such as: Google Chrome, Mozilla Firefox, Microsoft Edge, Safari (macOS only),
• Internet connection with a bandwidth of at least: 10 Mb/s.

You can use the Platform if you are at least 18 years old.

YOUR ACCOUNT

In order to use the services, you must have an account on the Platform. You may also be asked to log in to accounts with Payment Processing Entities depending on the chosen payment method.

You are responsible for maintaining the confidentiality of your account and password. We recommend that you set a strong password for your account, consisting of uppercase and lowercase letters, numbers, and special characters, or use a password manager.

INFORMATION ABOUT SERVICES

HEADS HERE offers the following services on the Platform:

• writing and editing resumes, CVs, and cover letters;
• optimizing LinkedIn profiles, including providing you with instructions on how to proceed;
• online consultations regarding career development.

The services are provided electronically. Detailed information about the services can be found on the Platform.

TERMS OF PURCHASE OF SERVICES

The conclusion of the Sales Agreement can take place through the Platform. To purchase a service, it is necessary to meet the minimum technical requirements mentioned in these Service Terms. After selecting the service, in order to conclude the Sales Agreement, you should proceed to the cart, and then – after verifying the contents of the cart – to the order form, where you will be asked to:

• provide the necessary data for concluding the Sales Agreement, namely your first name, last name, email address, country;
• declare whether you want to receive an invoice;
• choose the payment method;
• accept the Service Terms;

Before concluding the Sales Agreement, you will be able to give consent for the processing of special categories of data – we will need your consent if you provide us with your health information.

To properly submit an order and conclude the Sales Agreement, you should click the “ORDER AND PAY” button. After clicking the “ORDER AND PAY” button, you will be redirected to the Payment Service Provider’s website and you will receive an email containing confirmation of your order along with its details and these Service Terms. After placing and paying for your order, we will ask you on the Platform to complete a survey and send the information necessary to provide the Service in pdf or doc/docx format.

We provide services after receipt of payment by HEADS HERE and you have provided the information necessary to begin providing the Service.

The delivery of Services will start:

• after 14 days from the date of Purchase of the Service and will be completed by 14 days from the day HEADS HERE receives all the information necessary to execute the Sales Agreement;
• Immediately after the Purchase of Services, if you express your consent on the Platform to start providing Services before the 14-day period during which you have the right to withdraw from the Sales Agreement, while simultaneously waiving that right; the delivery of services will then be completed by 14 days from the day HEADS HERE receives all the information necessary to execute the Sales Agreement.

The delivery time of the Service may be extended, in which case we will inform you.

PRICES

Information about the products included in the Platform constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code. If you are a consumer, we inform you that the price of the Service includes tax. If you order the Service as part of your business activity, you should pay tax or its equivalent yourself in the country where your company is based. HEADS HERE reserves the right to change prices on the Platform. Changes do not affect orders placed before their introduction. HEADS HERE has the right to introduce periodic promotions, the rules of which will be specified each time. If you have a discount code for services, enter it in the indicated field in the order form and the price of the service will be reduced by the discount amount. Information about the lowest price applicable at HEADS HERE for the service in the last 30 days is displayed on the Platform.

PAYMENT METHODS AND DELIVERY METHODS

You should make the payment within 3 days from the date of placing the order. Payment on the Platform is possible through an online service provider that mediates in the processing of payments, which is Stripe (“Payment Processing Entity”). Available payment methods are specified in the Service Terms and on the Platform. In order to use the services of the Payment Processing Entity, you may be required to accept the terms of service of that entity, and in some cases, also to create an account with the Payment Processing Entity. If you are interested in receiving an invoice, you should inform HEADS HERE by marking this in the Platform, and then you should follow the instructions.

The Product created during the provision of the Service will be provided to you electronically on the Platform in the doc/docx/pdf format.

WITHDRAWAL FROM THE SALES AGREEMENT AND REFUND OF PAYMENT

You have the right to withdraw from the Sales Agreement within 14 days from the date of purchase of the service without providing any reason by sending information about it to our registered HEADS HERE office address or electronically to the email address: office@headshere.com. You can use the template for the statement available HERE. If you consent to start using the electronic products we have prepared as part of the services before the 14-day period expires, you will lose the right mentioned in the previous clause, which we will inform you about on the Platform.

In the event of withdrawal from the contract, we will refund all payments made using the same payment method within 14 days from the date you submit your withdrawal statement.

DATA PROTECTION AND CONFIDENTIALITY

The data controller is HEADS HERE LLC („Controller”). Contact with the administrator is possible via post office or electronically (e-mail address: office@headshere.com). Your personal data is processed with respect for rights and freedoms, in accordance whit the GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons in relations to the procesing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation). The registered office of the Controller is located at Zygmunta Hubnera 1/282, 01-756 Warsaw, Poland. Providing personal data is necessary to conclude and perform the Sales Agreement between you and HEADS HERE. The following data is required to place an order in the Service: first name, last name, email, country.

ELECTRONIC COMMUNICATION

We will communicate with you electronically through the Platform or via email regarding the implementation of the Services. We may send you commercial and marketing information electronically if you give your consent and agree to the processing of your personal data for marketing purposes.

We may send you a Newsletter electronically, under the terms specified in these Service Terms, if you express your desire to receive it through the form on the Platform.

NEWSLETTER

The administrator of the Newsletter is HEADS HERE. The Newsletter is a service providing access to digital content, i. e. informative and educational materials related to the activites of HEADS HERE, as well as containing materials promoting the HEADS HERE brand. The Newsletter may also include commercial information related to specials offers directed to you.

To receive our Newsletter, it is necessary to:

• fill out the form and click the “subscribe to Newsletter” button, and then click the activation link that we will send to the email address you provided in the form;
• Express your consent to receive commercial and marketing information electronically.

To receive the Newsletter, you must have internet access, a properly functioning web browser for email handling, and a valid email address.

In order to provide the digital content access service in the form of a Newsletter, we will process your personal data, such as: your name and email address.

The Newsletter service will be provided indefinitely from the moment of activating the activation link, which you will receive after subscribing to the Newsletter. The service will be provided until you unsubscribe from the Newsletter or withdraw from the agreement. The Newsletter service is provided free of charge. However, if you wish to receive paid digital content from HEADS HERE, please contact the administrator by sending a message to: office@headshere.com.

HEADS HERE holds copyright to the digital content delivered through the Newsletter and grants you a free, unlimited time and geographically unrestricted license to use it. It is prohibited to use the digital content provided through the Newsletter for purposes other than private use, as well as to reproduce or distribute it.

If you believe that the digital content received from us via the Newsletter does not comply with these Service Terms, you may file a complaint under the conditions described in this document.

At any time, you may terminate the service contract for access to digital content in the form of a Newsletter by unsubscribing, by contacting us via email at office@headshere.com, through the contact form available on www.headshere.pro or by clicking the link provided for this purpose in the Newsletter.

COMPLAINTS

You can submit a complaint in the following ways: in writing or electronically (by sending it via email to office@headshere.com). When submitting a complaint, please provide your name and order number so that we can identify you, and include information regarding the subject of your complaint. We will respond to the complaint within 14 days from the date of its receipt, using the same communication channel through which you submitted your complaint.

REFUND POLICY

We provide services professionally. The documents we deliver are of the highest quality. You have the opportunity to provide feedback on the materials you receive from us twice, based on which we will make corrections at no extra charge. We are committed to your satisfaction, so we encourage you to share your comments and opinions, as they will help us prepare documents that will meet your expectations.

After the service has been delivered, you will not have the option to return it. If you have purchased a document package (resume/CV + cover letter + LinkedIn profile), and we deliver you only part of the package, you can apply for a partial refund of the service cost. Send your application to the address office@headshere.com. We will respond to it within 14 days.

We are confident in the effectiveness of our services. However, if within 60 days of the completion of our services you do not receive any invitations for job interviews, we will improve your resume/CV at no additional cost, provided that you:

• purchased our Standard, Professional, Premium, or Executive package,
• applied for at least 15 job offers within 60 days from the date you received your resume/CV from us and used the final version of the document that we provided (without making your own modifications),
• file a complaint within 90 days from the date you received the final version of your resume/CV from us,
• document that you applied for 15 job offers by sending us links to the job offers, application documents (confirmation emails, screenshots, platform logs), and copies of the resumes/CVs you used in your applications.

As part of the guarantee, we will conduct a through audit of your resume/CV. It will be updated by a Senior Resume Writer, and you will receive personalized advice on improving your job aplication strategies.

COPYRIGHT

HEADS HERE holds exclusive copyright to the Platform and the materials contained therein, in particular to the images and service descriptions. Their use by copying and sharing without prior consent from HEADS HERE is prohibited. If you accept these Service Terms and pay for Services, HEADS HERE grants you limited, non-exclusive, non-transferable license that is not sublicensable to acess HEADS HERE Services and to use them form personal and non-commercial purposes.

RESPONSIBILITY

HEADS HERE does not bear any responsibility for the course and outcome of the recruitment processes in which you will participate using the materials and information received from HEADS HERE in connection with the Service provided, in particular resumes, CVs, cover letters, Linkedin profiles optimized by HEADS HERE, and consultations provided by HEADS HERE.

HEADS HERE is not responsible for partial or total failure to fulfill obligations arising from the Service Terms when their execution is not possible due to force majeure or other circumstances beyond the control of HEADS HERE. HEADS HERE will inform you electronically about the occurrence of force majeure, its duration, and consequences. HEADS HERE will resume fulfilling its obligations promptly after the force majeure event has ceased.

OUT-OF-COURT METHODS OF DISPUTE RESOLUTION

You can use out-of-court methods for handling complaints and pursuing claims related to online transactions. The platform for online dispute resolution between Consumers and sellers is located at: http://ec.europa.eu/consumers/odr/.

APPLICABLE LAW

Due to the fact that HEADS HERE is headquartered in the European Economic Area, we are obliged to comply with the regulations applicable in the European Union, as well as Polish national regulations. By using the services of HEADS HERE, you irrevocably and unconditionally agree to submit to the exclusive jurisdiction of Polish courts and waive any objections regarding improper jurisdiction in the event of claims or disputes related to the services provided under these Service Terms. At the same time, you irrevocably and unconditionally agree that you will not invoke improper local jurisdiction in court proceedings.

CHANGES TO THE TERMS OF SERVICE

We reserve the right to change these Service Terms form important reasons, in particular in the event of changes in applicable laws affecting our operations, changes in the scope of services provided, and developmental work on the Platform that may impact the rules of providing services electronically.

In matters not regulated by the Regulations, the generally applicable legal provisions shall apply, in particular the provisions of the Civil Code, the Consumer Rights Act, GDPR, the Copyright and Related Rights Act.
